Immigration and Customs Enforcement (ICE) Officials are being very aggressive in enforcing immigration laws. As a result, more and more foreign nationals are being arrested and placed in immigration detention for removal proceedings. However, in some cases, the detained individual may be eligible for a bond. A bond allows the individual to be released from detention while their case is progressing through the Courts. The bond amount is set by ICE or an Immigration Judge. The bond payment serves as a guarantee to the U.S. government that the individual will attend all future Immigration Court hearings if released.
Once the bond is paid and the individual is released from detention, the case moves from the “detained” to the “non-detained” docket. Therefore, individuals released on bond have more time to gather the relevant evidence to support their case or to get their affairs in order if they have no relief.
